Legal services in typical residential sales include the following:

  • Reviewing or preparing the contract to make sure that the clients' interests are protected.

  • Verifying and explaining tax consequences.

  • Negotiating issues that arise during inspection of the property.

  • Coordinating with lenders to make sure that their requirements are met.

  • Monitoring deadlines for contingencies, mortgage commitments and the like.

  • Reviewing title and survey including title clearance and title insurance.

  • Managing pre-closing preparations including obtaining lien releases, satisfying local requirements, preparing closing documents and closing figures.

  • Reviewing closing figures to make sure that transaction costs are appropriate and reasonable.

The closing of a residential purchase and sale is the culmination of the transaction yet accounts for less than 5% of the work expended in most transactions.
